Conditions of use for ABS Business Reporting

Licence

ABS Business Reporting along with the information provided to you via this website is licensed by the Commonwealth of Australia, represented by the Australian Bureau of Statistics (ABS). 

Using our Services

Access to ABS Business Reporting is provided to you by the ABS for the purpose of completing and submitting ABS business reports to the ABS. You may not decompile, reverse engineer, dissemble, or otherwise attempt to derive the source code for ABS Business Reporting or sub-license, distribute or create derivative works based on the software, in whole or in part.  

Your ABS Business Reporting

You must:  

  • be a natural person to access or seek to access the ABS Business Reporting; 
  • not access any other person’s ABS Business Report unless you have been authorised to do so; 
  • not permit any other person to use your User Identifier or password; 
  • keep your User Identifier and password secure at all times; 
  • advise the ABS immediately if you suspect that the security of your ABS Business Reporting may have been compromised e.g. your User Identifier or password has been lost or stolen; 
  • not take any action to jeopardise, limit or interfere in any manner with the intellectual property rights with respect to ABS Business Reporting. 

Copyright Protection

ABS Business Reporting is protected by copyright.  

The content of ABS Business Reporting (e.g. the report or individual questions) cannot be adapted or used for commercial purposes, pursuant to the Creative Commons: Attribution, Non Commercial, No Derivatives license.

Security

You are responsible for maintaining the security of your User Identifier and password, and of the environment in which ABS Business Reporting is used. Please see our increasing your safety online page for tips on improving your safety online.  

Privacy

The Australian Bureau of Statistics (ABS) is bound by the Census and Statistics Act 1905 to maintain the confidentiality of all information supplied to us. Please see our Privacy page for more information.  

Warranties and Liability

The ABS will accept completion of an ABS business report where the provider/respondent has followed the instructions provided by ABS Business Reporting fully and honestly. The provider/respondent accepts that ABS Business Reporting has been provided solely to assist members of the public to discharge their obligations through an alternative method of completion and the ABS cannot accept any responsibility for the use or operation of ABS Business Reporting.  

The ABS gives no warranty that ABS Business Reporting is free of fault. The ABS will not be liable, except pursuant to any implied warranty, for any loss or damage caused, whether due to negligence or otherwise, arising from use of, or reliance on ABS Business Reporting. In no event shall the total liability of the ABS to you for all damages exceed the value of this licence. If any dispute arises under this licence, the prevailing party shall be reimbursed by the other party for any and all legal fees and costs associated with dispute resolution.  

The ABS accepts no liability for any interference with or damage to a user's computer system, software or data occurring in connection with or relating to ABS Business Reporting.  

Modifying and Terminating our Services

ABS Business Reporting may be used for the provision of data to the ABS. Your rights to use ABS Business Reporting may be terminated without notice from the ABS if you fail to comply with the Terms of Use.  

In this situation the ABS will contact you to arrange an alternate method to provide your data.  

Your ABS Business Reporting dashboard will still be accessible after the completion of your ABS Business Report and can be accessed via your login details, should you require. You will be able to download a copy of previous reports submitted through ABS Business Reporting by using the 'Past reports' tab found on the Dashboard.  

You are able to revoke ABS Business Reporting access to your accounting software at any time using your accounting software’s application access controls. ABS Business Reporting's Getting Started page provides instructions on this.

You will not be able to provide data to the ABS through ABS Business Reporting while your account is disabled. 

About these Terms

This licence is covered by the laws of the Australian Capital Territory. Where a court finds that any provision of this licence to be unenforceable, the remainder of this licence shall continue in full force and effect.
