ABS Online Survey - Conditions of Use

Licence

The ABS Survey Account and ABS Online Survey along with the information provided to you via this website is licensed by the Commonwealth of Australia, represented by the Australian Bureau of Statistics (ABS).

Using our Services

Access to ABS Survey Account and ABS Online Survey is provided to you by the ABS for the purpose of completing and submitting survey form(s) to the ABS. You may not decompile, reverse engineer, dissemble, or otherwise attempt to derive the source code for ABS Survey Account or ABS Online Survey (including individual surveys) or sub-license, distribute or create derivative works based on the software, in whole or in part. 

Your ABS Survey Account or ABS Online Survey

You must: 

  • be a natural person to access or seek to access the ABS Survey Account or ABS Online Survey;
  • not access any other person’s ABS Survey Account or ABS Online Survey;
  • not permit any other person to use your User Identifier, password and secret questions and answers;
  • keep your User Identifier, password and secret questions and answers secure at all times;
  • advise the ABS immediately if you suspect that the security of your ABS Survey Account or ABS Online Survey may have been compromised e.g. your password or User Identifier has been lost or stolen;
  • not take any action to jeopardise, limit or interfere in any manner with the intellectual property rights with respect to ABS Survey Account or ABS Online Survey.
     

Copyright Protection

ABS Survey Account and ABS Online Survey is protected by copyright. 

The content of any ABS Survey (e.g. the form or individual questions) cannot be adapted or used for commercial purposes, pursuant to the Creative Commons: Attribution, Non Commercial, No Derivatives license.

Security

You are responsible for maintaining the security of your User Identifier, password and security questions and answers, and of the environment in which ABS Survey Account and ABS Online Survey is used. Please see our increasing your safety online page for tips on improving your safety online. 

Privacy

The Australian Bureau of Statistics (ABS) is bound by the Census and Statistics Act 1905 to maintain the confidentiality of all information supplied to us. Please see our Privacy page for more information. 

Warranties and Liability

The ABS will accept completion of a survey form where the provider/respondent has followed the instructions provided by ABS Survey Account or ABS Online Survey fully and honestly. The provider/respondent accepts that ABS Survey Account or ABS Online Survey has been provided solely to assist members of the public to discharge their obligations through an alternative method of completion and the ABS cannot accept any responsibility for the use or operation of ABS Survey Account or ABS Online Survey. 

The ABS gives no warranty that ABS Survey Account or ABS Online Survey is free of fault. The ABS will not be liable, except pursuant to any implied warranty, for any loss or damage caused, whether due to negligence or otherwise, arising from use of, or reliance on ABS Survey Account or ABS Online Survey. In no event shall the total liability of the ABS to you for all damages exceed the value of this licence. If any dispute arises under this licence, the prevailing party shall be reimbursed by the other party for any and all legal fees and costs associated with dispute resolution. 

The ABS accepts no liability for any interference with or damage to a user's computer system, software or data occurring in connection with or relating to ABS Survey Account or ABS Online Survey. 

Modifying and Terminating our Services

ABS Survey Account or ABS Online Survey may be used for the provision of data to the ABS. Your rights to use ABS Survey Account or ABS Online Survey may be terminated without notice from the ABS if you fail to comply with the Terms of Use. 

In this situation the ABS will contact you to arrange an alternate method to provide your data. 

Your ABS Survey Account will still be accessible after the completion of your survey form(s) and can be accessed via your login details, should you require. If you wish to have your ABS Survey Account disabled, please Contact Us. If you use ABS Online Survey to provide data to the ABS this functionality is not available to you at this time. 

About these Terms

This licence is covered by the laws of the Australian Capital Territory. Where a court finds that any provision of this licence to be unenforceable, the remainder of this licence shall continue in full force and effect.
