ABS conditions of use and copyright

By accessing the ABS Survey Account and ABS Online Survey (the Services), you agree to comply with and be legally bound by the following Conditions of Use. If you do not agree to these Conditions of Use, you must not use the Services.

The Commonwealth as represented by the Australian Bureau of Statistics (ABS) owns copyright in the Services, including all forms and associated questions. 

Notwithstanding any other copyright notice on the ABS website, and unless otherwise stated in these Conditions of Use, all other rights are reserved.

The ABS Surveys (e.g. the forms and individual questions) are licensed under CC BY-NC-ND 4.0 licence.

The Commonwealth Coat of Arms, the ABS logo and third party material and logos are excluded from the operation of this licence.

Under the above licence, you must attribute ABS as the source of the ABS Surveys using the Commonwealth copyright notice set out above. 

In addition, you must not:

  • make changes to the survey forms or questions
  • use the survey forms or questions for commercial purposes
  • create new versions of the survey forms or questions.

Using our Services

The ABS provides the Services so that you can provide us with your survey information safely and via an online method.

You must not:

  • break apart, copy, or investigate how the ABS survey software works
  • change the ABS survey software or create new software from it
  • share, sell, or pass on any part of the ABS system, ABS Survey Account or ABS survey questions.

These Services are to be used only to complete ABS surveys.

Your responsibilities

When using the Services, you must:

  • be a real person (not an automated tool)
  • only access your own account
  • not allow anyone else to use your login details
  • keep your account login details secure
  • advise the ABS straight away if you think someone else has your login details
  • avoid doing anything that harms the ABS, the Services or ABS online material.

Your survey responses

Subject to restrictions relating to privacy, confidentiality and security, you consent to the ABS reproducing, using, analysing, storing and publishing your survey responses and statistics based on your survey responses for ABS functions, purposes and activities, including those required under ABS legislation.

Privacy, confidentiality and security

The ABS is bound by the Census and Statistics Act 1905 to maintain the confidentiality of all information supplied to us in your ABS survey. Where the information supplied is personal information, the ABS is also bound by the Privacy Act 1988.

You are responsible for maintaining the security of your ABS Survey account login details. You are also responsible for the environment in which the Services are used.

Warranties and liability

The ABS will accept your survey when you follow the ABS survey instructions and answer honestly.

We aim to provide reliable services. However:

  • we cannot guarantee that the Services will always be available, current or free from error.
  • except where required by law, the ABS will not be liable for any loss or damage suffered by you (whether caused by negligence or an act or omission involving fault) that comes from your use of, or reliance on, these Services.

The ABS is not responsible for any interference with, or damage to, your device, software or data that occurs when you use the Services.

Ending or changing access

Your access may be stopped without notice if you do not follow these Conditions of Use.

If this happens, the ABS will contact you to provide another way to provide your data.

Your ABS Survey Account stays available after you complete your survey.
If you wish to disable your account please contact us.

About these Conditions of Use

These Conditions of Use are governed by the laws of the Australian Capital Territory (ACT).

If a court finds any part of these Conditions of Use invalid, the remainder of the terms will still apply.
