eCensus Disclaimer

1. Licence.

The eCensus Forms and related information (eCensus) which is the subject of this Agreement may be provided in any media form. eCensus is licensed to you by the Commonwealth of Australia represented by the Australian Bureau of Statistics ('ABS').

Permitted Uses and Restrictions.

You may use eCensus under the terms and conditions set out in this Agreement. eCensus is protected by copyright and other intellectual property laws and by international treaties. You may not take any action to jeopardise, limit or interfere in any manner with the intellectual property rights with respect to eCensus. You will take all reasonable measures to protect eCensus from unauthorised use, reproduction, distribution or publication.

This Agreement allows you to open and use eCensus on a computer for the purposes of completing and submitting your 2004 Census Test Form to the ABS. You may not decompile, reverse engineer, dissemble, or otherwise attempt to derive the source code for eCensus, or sub-license, distribute or create derivative works based upon eCensus Software in whole or in part.


3. Disclaimer of Warranty on eCensus Form.


The ABS will accept completion of a Census form where the respondent has followed the instructions in eCensus fully and honestly. The respondent accepts that eCensus has been provided solely to assist members of the public to discharge their obligations through an alternative method of completion and the ABS cannot accept any responsibility for the use or operation of eCensus.

Limitation of Liability.

The ABS gives no warranty that the eCensus form is free of fault. The ABS will not be liable, except pursuant to any implied warranty, for any loss or damage howsoever caused whether due to negligence or otherwise arising from use of or reliance on eCensus. In no event shall the total liability of the ABS to you for all damages exceed the value of this licence. If any dispute arises under this Agreement, the prevailing party shall be reimbursed by the other party for any and all legal fees and costs associated with dispute resolution.


5.
Term and Termination.

You may use eCensus for the 2004 Census Test only. Your rights to use eCensus will terminate automatically without notice from the ABS if you fail to comply with any term of this Agreement.


6.
Security.

You are responsible for maintaining the security of your eCensus number and of the environment in which eCensus is used and submitted.


7.
Applicable Law and Severability.

This Agreement is covered by the laws of the Australian Capital Territory. Where a court finds that any provision of this Agreement to be unenforceable, the remainder of this Agreement shall continue in full force and effect.


8.
Use outside Australia.

If on Census night you are located outside Australia or its prescribed Territories, you are not required to complete a Census form.
