Description

Miscellaneous offences are any offences that are not elsewhere classified.

171 Miscellaneous commercial offences

Description

Miscellaneous commercial offences include business, corporate, or other commercial offences that do not involve physical harm, deception, trafficking, fraud, pollution, sale of stolen goods, or breach of health and safety regulations.

1711 Import and export offences

Import and export offences include the movement of prohibited or controlled goods or other products across international borders, other than weapons, explosives, child abuse material, drugs, animals, or plants.

Inclusions:

  • Unlawful import or export of alcohol, tobacco, or similar products
  • Unlawful import or export of commercial products other than weapons, explosives, child abuse materials, drugs, animals, or plants

1712 Financial management or corporate governance offences

Financial management or corporate governance offences include breaches of regulations relating to the financial management or governance of an organisation, excluding where fraud, deception or corruption occurs. The organisation may be a business, non-profit organisation, or any other incorporated entity. 

Inclusions:

  • Breach director’s duties, excluding corruption or other deception
  • Breach financial regulations
  • Breach regulation relating to the management of a corporation
  • Criminal misconduct by company officers not elsewhere classified

1713 Unlawful purchase or sale of sexual services

This group is for offences relating to the purchase or sale of sexual services, where the act is unlawful due to a breach of regulation, or the location of the act.

Sexual services include private sex work, street-based sex work, sex work through an escort agency or as a private escort, or where a worker provides sexual services at a brothel, club, or erotic massage parlour. It does not include livestreaming, chat services, phone sex, or other non-contact sexual services delivered through a digital platform.

Inclusions:

  • Breach regulatory requirements relating to sex work
  • Offences related to the prevention of “pimping”
  • Operation of an unregistered brothel or other venue providing sexual services
  • Own or manage an unlicenced or unregistered brothel

This group is for miscellaneous commercial offences not elsewhere classified. 

Inclusions:

  • Demand or receive payment for building without insurance
  • Interfere with the provision of electricity or other utilities during commercial activities, excluding theft or property damage
  • Unlawfully undertake building or trades work without a licence
  • Other miscellaneous commercial offences not elsewhere classified

Exclusions:

  • Commercial offences involving deception or fraud – coded to the relevant group in 082 Deceptive business practices

172 Local offences

Description

Local offences are offences relating to the management of a local municipal area. This includes offences relating to land use, construction of buildings, and local amenity. It also includes bylaws created by local governments within Australia and New Zealand, where these laws are not elsewhere classified.

1721 Construction and land use offences

Construction and land use offences include breaches of planning regulations, building permits, or land zoning, and other offences relating to the construction of buildings or use of land.

Inclusions:

  • Breach a building permit, planning permit or planning regulations
  • Breach heritage regulations
  • Breach regulations relating to traditional ownership or protection of sacred sites
  • Change use of building without required permit
  • Construction without required permit
  • Contravene town planning requirements
  • Demolition or destruction of a building in breach of heritage or planning regulations
  • Fail to comply with land use planning legislation
  • Undertaking an activity that is not permitted due to zoning restrictions
  • Other construction and land use offences

Exclusions:

Pet registration and management offences relating to the registration and management of domestic animals such as dogs or cats. 

Inclusions:

  • Breach domestic animal bylaws, such as cat curfews, or failure to complying with signage requirements for a declared dangerous dog

  • Breach regulations relating to maximum number of dogs or other pets
