Description

Offences against government include offences that negatively impact the effective undertaking of government operations, including the delivery of government services and protection of national security. 

This division does not include offences relating to damage of public land or government property, data theft, attacks on digital networks, assault of government representatives, or corruption within government.

151 Offences against national security

Description

Offences against national security are acts or omissions that threaten or diminish the effective enforcement of government operations concerned with the preservation of national security. 

1511 Terrorism offences

This group is for offences relating to terrorist acts and terrorism organisation offences.

Terrorist act offences include:

  • Advocating terrorism
  • Being engaged in a terrorist act
  • Financing terrorism, and financing a terrorist
  • Planning a terrorist act
  • Possessing things connected with terrorist acts
  • Preparing for a terrorist act
  • Receiving training connected with terrorist acts
  • Training others for terrorist acts

Terrorism organisation offences include:

  • Associating with a terrorist organisation
  • Directing the activities of a terrorist organisation
  • Getting funds to, from or for a terrorist organisation
  • Membership of a terrorist organisation
  • Providing support to a terrorist organisation
  • Recruiting for a terrorist organisation
  • Training involving a terrorist organisation

A terrorist organisation is an organisation that is engaged in preparing, planning, assisting, or fostering the doing of a terrorist act – or that the Australian or New Zealand government has formally listed as a terrorist organisation or designated terrorist entity. 

Where terrorist acts lead to another offence, that offence may also be coded separately.

1519 Offences against national security, nec

This group is for offences against national security that are not elsewhere classified.

Inclusions:

  • Burn a flag
  • Disclose, buy, or sell, national secrets
  • Espionage against government
  • Foreign incursion offences
  • Foreign interference offences
  • Impersonate a police officer, border security officer or justice official
  • Incite or enact mutiny
  • Interfere with defence force operations, where the act does not amount to terrorism

Subdivision

152 Offences against government services

Description

Offences against government services are acts that interfere with, cause harm to, or otherwise negatively impact government services or structures, other than relating to government security. This includes offences against any level of government, and government statutory agencies or agencies that operate under government regulation.

1521 Resist or hinder a government representative

Government representatives refer to any employee undertaking their role within any level of government, excluding police, justice officials, defence force or government security officers. 

This may include customs officials, emergency services workers, government service providers, and compliance officers employed by government such as parking inspectors, food safety inspectors, workplace safety inspectors, and others. It does not include workers outside the public sector.

This group excludes assault, bribery, and fraud.

Inclusions:

  • Intentionally block, hinder, or otherwise prevent a government representative from undertaking a task or action required for their job
  • Physically resist a government representative undertaking their job
  • Prevent a government representative from entering or leaving their workplace or other location
  • Refuse to follow directions of customs officials, emergency services workers, or other government representatives
  • Other acts that hinder a government representative in the course of their work not elsewhere classified

Exclusions:

1522 Migration offences

Migration offences include visa offences, unlawful entry into Australia or New Zealand, and aiding unlawful entry. It excludes human trafficking offences.

  • Unlawfully leaving the country where no other offence has occurred

1523 Voting or electoral offences

This group includes offences related to elections and voting.

Inclusions:

  • Breach regulations relating to voting or elections
  • Fail to register to vote in New Zealand
  • Fail to vote in an Australian local, state, territory, or national election
  • Illegal voter registration
  • Intentional miscounting of votes
  • Interference with voting or electoral processes
  • Political fraud

1529 Offences against government services, nec

This group is for other offences against government services that are not elsewhere classified.

Inclusions:

  • Hoax calls to emergency services

  • Refusal by a public officer to perform a duty
  • Other offences against government services not elsewhere classified

Exclusions:
