05 AUDIO AND VIDEO MEDIA AND ONLINE CONTENT


0501 MAGNETIC TAPES AND OTHER PREPARED UNRECORDED MEDIA FOR SOUND OR VIDEO RECORDING, INCLUDING OPTICAL MEDIA, NOT RECORDED

      Includes:

        magnetic tapes, unrecorded, for recording sound, video or other recordings;

        magnetic tape cartridges, unrecorded;

        cassettes, unrecorded, for recording video, sound or other recordings;

        magnetic floppy disks, unrecorded; and

        unrecorded disks prepared for laser-beam recording: compact disks (CDs), DVD, other optical media.


      Excludes:

        recorded magnetic or optical media; audio, video or text-based (included in Class 502);

        hard disks (out of scope of the classification);

        packaged software (out of scope of the classification);

        unexposed cinematographic film (out of scope of the classification); and

        cards with magnetic stripe (out of scope of the classification).


0502 RECORDED MEDIA FOR SOUND
      Includes:

        physical media (CDs, cassette tapes, vinyl records etc) containing recordings of: musical sound material; audio books (i.e. audio recordings of someone reading the text of a book); non-musical audio recordings (such as recordings of speeches, sound samples and natural sounds or other phenomena, to generate a certain ambience or mood).

      Excludes:

        contract technical recording services (included in Class 0401);

        music videos and DVDs (included in Class 0503);

        musical audio downloads and streamed audio content (included in Class 0504);

        master original recordings produced for outright sale (i.e. with all property rights) (included in Class 0912);

        retailing of phonorecords (including electronic sound files) produced by others (out of scope of the classification); and

        reproduction services of recorded media (out of scope of the classification).


0503 RECORDED MEDIA FOR VISION
      Includes:

        physical media (e.g. video cassettes, DVDs etc) containing video recordings; and

        physical media (CD-ROM, diskette, microfilm, microfiche etc) containing non-audio recordings of text material, such as: from periodicals, reference books and other sources.


      Excludes:

        audio disks and tapes (included in Class 0502);

        films and other video downloads and streamed video content (included in Class 0505);

        original recordings produced for outright sale (ie with all property rights) (included in Class 0911);

        reproduction services of recorded media (out of scope of the classification);

        retailing of DVDs produced by others (out of scope of the classification); and

        physical media (CD-ROM, diskette, microfilm, microfiche etc) containing non-audio recordings of textbooks and mailing lists (out of scope of the classification).


0504 MUSICAL AUDIO DOWNLOADS AND STREAMED AUDIO CONTENT
      Includes:

        electronic files containing musical audio recordings that can be downloaded and stored on a local device; and

        streamed audio data sent over the Internet.

0505 FILMS AND OTHER VIDEO DOWNLOADS AND STREAMED VIDEO CONTENT
      Includes:

        electronic files containing films and other video recordings that can be downloaded and stored on a local device;

        streamed video data sent over the Internet; and

        online adult content published or broadcast over the internet.


      Excludes:

        adult content in on-line newspapers, periodicals, books, directories (included in Classes 0309 to 0311).
