SENTENCE OUTCOMES

Information on sentence outcomes in Chapter 3 do not apply the concept of a principal sentence (as applied in Chapter 2). Sentence outcomes presented in this chapter represent all sentences handed down for each offence proven guilty. Where multiple sentence types are handed down for a single offence, these are counted multiple times. As such the total number of sentence outcomes recorded is greater than the number of sentences proven guilty.

Monetary orders were the most common sentence type to be issued overall, comprising 54% (17,933) of all sentence outcomes handed down by the courts. These orders predominantly related to fraud offences (80%) and financial offences (6%).

The Higher courts issued custodial orders in 79% of the sentence outcomes finalised by the courts, compared with 15% in the Magistrates' and Children's courts. Of the 33,438 offences proven guilty, across all court levels, 19% (6,398) received a custodial order.

Fraud offences comprised 71% (4,549) of all custodial orders, followed by financial offences (7%) and communications offences (6%).

Over three quarters of all convictions for drug offences (77%) and sexual offences (76%) resulted in a custodial order, followed by security offences (66%) and justice procedure offences (63%).

Community supervision and work orders were issued most predominantly for Commonwealth property offences (23%) and communications offences (13%).
